TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-18-1310 SO AS TO REQUIRE A BIENNIAL REVIEW OF A SCHOOL DISTRICT BOARD OF TRUSTEES AND TO ALLOW THE REVIEW TO TAKE PLACE IN EXECUTIVE SESSION; AND TO AMEND SECTION 30-4-70, AS AMENDED, RELATING TO MEETINGS THAT MAY BE CLOSED TO THE PUBLIC AS EXCEPTIONS TO THE FREEDOM OF INFORMATION ACT, SO AS TO ALLOW THE BIENNIAL REVIEW OF A SCHOOL DISTRICT BOARD OF TRUSTEES TO BE HELD IN EXECUTIVE SESSION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 13, Chapter 18, Title 59 of the 1976 Code is amended by adding:
"Section 59-18-1310. (A) The State Board of Education, based on the recommendation of the Division of Accountability established in Section 59-6-100, must develop regulations requiring that not later than August 1, 2002, each district board of trustees must undergo a biennial review to reinforce the state accountability system. The board review must reflect and evaluate the board's emphasis on and response to the district and school activities and plans required in Section 59-139-10.
(B) The biennial review may be conducted in executive session pursuant to Section 30-4-70(a)(7)."
SECTION 2. Section 30-4-70(a) of the 1976 Code, as last amended by Act 423 of 1998, is further amended by adding a new item at the end to read:
"(7) The biennial review of a school district board pursuant to Section 59-18-1310."
SECTION 3. This act takes effect upon approval by the Governor.
