TO AMEND SECTION 57-7-10, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CRIMINAL AND CIVIL LIABILITY OF A PERSON WHO NEGLIGENTLY, WILFULLY, OR WANTONLY DAMAGES A HIGHWAY, SO AS TO PROVIDE THAT ALL PROCEEDS COLLECTED FROM DAMAGE CLAIMS FILED BY A HIGHWAY AUTHORITY PURSUANT TO THIS PROVISION MUST BE USED BY THE HIGHWAY AUTHORITY TO REPAIR THE DAMAGED PROPERTY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 57-7-10 of the 1976 Code is amended to read:
"Section 57-7-10. (A) Any A person who shall negligently, wilfully or wantonly damage damages a highway, highway facility, highway structure, or trees or shrubs on a highway shall be guilty of a misdemeanor and, upon conviction, shall be fined not more than one hundred dollars or imprisoned for not more than thirty days. Any such This person shall also be liable to the proper highway authorities in charge for the cost of such injury or damage in a civil action.
(B) All proceeds collected from damage claims filed by a highway authority pursuant to this section must be used by the highway authority to repair the damaged property."
SECTION 2. This act takes effect upon approval by the Governor.
