TO AMEND CHAPTER 11, TITLE 50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PROTECTION OF GAME, BY ADDING SECTION 50-11-1763 SO AS TO PROVIDE THAT A PERSON OWNING A FOX HUNTING ENCLOSURE MAY PURCHASE AND RELEASE LIVE COYOTES INTO HIS PEN, TO PROVIDE FOR LICENSES, FEES, AND TAGS FOR TRAPPED COYOTES, AND TO PROVIDE PENALTIES FOR VIOLATIONS OF THIS SECTION; AND TO AMEND SECTION 50-11-1760, AS AMENDED, RELATING TO BRINGING, RELEASING, OR TRAPPING COYOTES IN THIS STATE, SO AS TO REVISE THE SECTION BY DELETING A PROVISION AUTHORIZING BRINGING A COYOTE INTO THIS STATE FOR EXHIBITION PURPOSES, AND INCREASE THE PENALTIES FOR VIOLATIONS OF THIS SECTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 8, Chapter 11, Title 50, of the 1976 Code is amended by adding:
"Section 50-11-1763. (A) A person who owns a fox hunting enclosure may be licensed annually to purchase live coyotes for release into his pen. The license is issued by the department at a cost of fifty dollars. The coyotes must be obtained from a South Carolina licensed commercial trapper. Both the trapper and the owner of the enclosure must provide annually, on forms provided by the department, a record of coyote purchases or transfers.
(B) A licensed trapper taking coyote pursuant to subsection (A) must tag the coyote in both ears prior to removing the coyote from the trap. The tags must be securely attached and may not be removed. The department must provide the tags at a cost of one dollar each. The tags are nontransferable and may not be altered in any manner.
(C) A person violating the provisions of subsection (A) is guilty of a misdemeanor and, upon conviction, must be fined not less than fifty dollars nor more than two hundred dollars, or imprisoned for not more than thirty days for each violation.
(D) A person violating the provisions of subsection (B) or found in possession of a live, untagged coyote trapped in this State is guilty of a misdemeanor and, upon conviction, must be fined not less than five hundred dollars nor more than one thousand dollars, or imprisoned for not more than one year for each violation. In addition, upon conviction, the department must suspend the trapper's or fox hunting enclosure owner's license for one year from the date of the conviction."
SECTION 2. Section 50-11-1760 of the 1976 Code, as last amended by Act 181 of 1993, is further amended to read:
"Section 50-11-1760. (A) It is unlawful to bring a coyote into the State in any manner, except one brought into the State and kept in captivity for exhibition purposes, or to release a coyote within the State. Any A violation of this section is punishable by imprisonment for not more less than one year five years or by a fine of not exceeding less than twenty five hundred thousand dollars. In addition, upon conviction, the department shall suspend the trapper's or fox hunting enclosure owner's license for five years from the date of the conviction.
(B) It is lawful for any a person to trap or kill any a coyote in this State at any time, but a permit must be obtained from the department before trapping coyotes outside the trap distance limits as prescribed in Section 50-11-2410."
SECTION 3. This act takes effect upon approval by the Governor.
