A BILL

TO AMEND SECTION 40-11-360, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PERSONS AND PROJECTS EXEMPT FROM OBTAINING A CONTRACTOR'S LICENSE, SO AS TO PROVIDE AN EXEMPTION FOR A MEMBER OF A CHURCH WHO IS BUILDING, REPAIRING, ADDING ON TO, OR ALTERING A BRICK VENEER, WOOD, OR STEEL FRAME STRUCTURE USED AS A RELIGIOUS FACILITY UNDER CERTAIN CONDITIONS AMONG WHICH ARE SQUARE FOOTAGE LIMITATIONS AND ROOFING REQUIREMENTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 40-11-360(A) of the 1976 Code is amended by adding an appropriately numbered item at the end to read:

"( ) An active member of a church who builds, repairs, builds an addition, or makes alterations to a brick veneer, wood, or steel frame structure, including performing interior work such as sheetrock, painting, carpentry, flooring, doors and windows, used as a religious facility under these conditions:

(a) a separate structure that has four separate walls must be less than five thousand square feet;

(b) mechanical work performed by an unlicensed active church member must be directly supervised by an active member of the church who currently owns an entity performing such work and has owned the entity at least five years or has previously owned an entity performing such work that was in business for fifteen years or more or by a properly licensed mechanical contractor;

(c) the roof decking and roof covering must be limited to work authorized for a general contractor specialty subclassification for general roofing and work involving the exterior covering of the structure and does not require supervision;

(d) structural work including, but not limited to, foundations, piers, load-bearing partitions, perimeter walls, exterior walls, floor joists, pilasters, girders, and rafters or any other work deemed by the board to be structural may only be performed under the direct daily supervision by a properly licensed general or residential contractor;

(e) federal, state, and local building codes, regulations, and ordinances must be followed;

(f) the church is fully responsible for any present or future construction problems."

SECTION 2. This act takes effect upon approval by the Governor.
