A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 20-7-885 SO AS TO PROHIBIT VACATING A CHILD SUPPORT ORDER UPON THE DEATH OF THE CUSTODIAL PARENT OR LEGAL GUARDIAN WITHOUT FIRST CONDUCTING A HEARING.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 20-7-885. An order requiring payment of child support may not be vacated upon the death of the custodial parent or legal guardian unless the court first conducts a hearing."

SECTION 2. This act takes effect upon approval by the Governor.
