A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-127-65 SO AS TO PROVIDE THAT BEGINNING JULY 1, 2003, THERE IS ESTABLISHED AT SOUTH CAROLINA STATE UNIVERSITY A LAW SCHOOL AND AN UNDERGRADUATE ENGINEERING SCHOOL AND TO PROVIDE FOR THE MANNER IN WHICH THE LAW SCHOOL AND ENGINEERING SCHOOL SHALL BE ESTABLISHED AND FUNDED INCLUDING A PROVISION FOR FACULTY AT THE UNIVERSITY OF SOUTH CAROLINA LAW SCHOOL IN COLUMBIA AND THE COLLEGE OF ENGINEERING OF THE UNIVERSITY OF SOUTH CAROLINA IN COLUMBIA TO ALSO TEACH AT THESE RESPECTIVE SCHOOLS AT SOUTH CAROLINA STATE UNIVERSITY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 59-127-65. (A) Beginning July 1, 2003, there is established at South Carolina State University a law school to be known as the South Carolina State University School of Law. The law school shall provide a three-year program of legal education to qualified graduates of undergraduate institutions based on admission criteria it shall establish and shall issue appropriate degrees. The law school shall seek accreditation from applicable accrediting bodies at the earliest possible opportunity. Graduates of the law school shall be eligible to take the South Carolina Bar examination upon graduation if they meet all other requirements for the examination. South Carolina State University shall provide suitable facilities to house the law school and shall employ and select a dean. Faculty for the law school shall be provided from the faculty at the University of South Carolina School of Law at Columbia based on a plan of rotation established by the Commission on Higher Education in consultation with the deans and boards of trustees of these schools. Nothing herein precludes either law school from having permanent or adjunct professors teaching at only one institution. The General Assembly in the annual general appropriations act shall provide for the necessary expenses and programs of the South Carolina State University School of Law.

(B) Beginning July 1, 2003, there is established at South Carolina State University an undergraduate School of Engineering. The engineering school shall provide a program of engineering education to qualified undergraduate students of the university based on criteria it shall establish. The engineering school shall seek accreditation from applicable accrediting bodies at the earliest possible opportunity. South Carolina State University shall provide suitable facilities to house the engineering school and shall employ and select a dean. Faculty for the engineering school shall be provided from the faculty at the University of South Carolina College of Engineering at Columbia based on a plan of rotation established by the Commission on Higher Education in consultation with the deans and boards of trustees of these schools. Nothing herein precludes either engineering school from having permanent or adjunct professors teaching at only one institution. The General Assembly in the annual general appropriations act shall provide for the necessary expenses and programs of the South Carolina State University School of Engineering."

SECTION 2. This act takes effect upon approval by the Governor.
