A JOINT RESOLUTION

TO PROVIDE FOR A SPECIAL ELECTION TO FILL A VACANCY IN THE OFFICE OF CLERK OF COURT OF CHESTERFIELD COUNTY FOR THE REMAINDER OF THE TERM.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    Notwithstanding any other provision of law, there must be conducted a special election to fill a vacancy in the office of the Clerk of Court of Chesterfield County. This election must be conducted at the time of the 2002 general election. The person elected shall serve for the remainder of the unexpired term and shall take office upon the certification of the election results.

    (B)    All persons desiring to qualify as a candidate and be elected to this office shall file written notice of candidacy as provided by Section 7-11-210 of the 1976 Code of Laws, except that the filing period for this office opens twelve noon on May 10, 2002 and closes at twelve noon on May 17, 2002.

    (C)    The county chairman shall place an advertisement to appear no later than three days before the filing period for this office in a newspaper of general circulation in Chesterfield County that otherwise complies with the provision of Section 7-13-45(4) of the 1976 Code of Laws, except for the time the advertisement is placed.

    (D)    The certification of the names of all candidates for this office to be placed on primary ballots must be made by the political party chairman to the authority charged by law with preparing the ballot no later than May 24, 2002.

    (E)    The primary election for the special election provided in this joint resolution must be held on the second Tuesday in June 2002.

    (F)    The party chairman shall advertise the date of the primary election for the special election three days before the primary in a newspaper of general circulation in Chesterfield County.

    (G)    Except as provided in this joint resolution, the authority charged by law with conducting an election shall conduct and supervise this special election in the manner provided for elections in Title 7 of the 1976 Code of Laws, mutatis mutandis.

SECTION    2.    This joint resolution takes effect upon approval by the Governor.
