A BILL

TO AMEND SECTIONS 61-4-520 AND 61-6-1820, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO AN APPLICATION FOR A PERMIT TO SELL BEER AND WINE AND THE CRITERIA APPLICABLE TO ISSUE A MINIBOTTLE LICENSE, SO AS TO REQUIRE AN APPLICANT TO FURNISH CERTIFICATION FROM THE MUNICIPALITY OR COUNTY IN WHICH THE BUSINESS IS TO BE CONDUCTED THAT THE APPLICANT IS IN COMPLIANCE WITH ALL APPLICABLE ZONING AND LAND USE ORDINANCES AND REGULATIONS OF THAT JURISDICTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 61-4-520 of the 1976 Code, as added by Act 415 of 1996, is further amended by adding an appropriately numbered item at the end to read:

    "( )    The applicant must provide certification from the municipality or county in which it is located that the proposed place of business of the applicant complies with all zoning and land use ordinances and regulations."

SECTION    2.    Section 61-6-1820 of the 1976 Code, as last amended by Act 363 of 1998, is further amended by adding an appropriately numbered item at the end to read:

    "( )    The applicant must provide certification from the municipality or county in which it is located that the proposed place of business of the applicant complies with all zoning and land use ordinances and regulations."

SECTION    3.    This act takes effect upon approval by the Governor.
