    To whom was referred a Bill (H. 3102) to amend the Code of Laws of South Carolina, 1976, by adding Section 23-1-230 so as to provide that the driver of a law enforcement vehicle may not exceed the speed limit, etc., respectfully

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-1-230 SO AS TO PROVIDE THAT THE DRIVER OF A LAW ENFORCEMENT VEHICLE MAY NOT EXCEED THE SPEED LIMIT TO ENTICE THE DRIVER OF A PRIVATE MOTOR VEHICLE TO FOLLOW HIM AT A SPEED THAT EXCEEDS THE SPEED LIMIT IN AN EFFORT TO HAVE THE DRIVER OF THE PRIVATE MOTOR VEHICLE CHARGED WITH SPEEDING BY A LAW ENFORCEMENT OFFICER TRAVELING IN ANOTHER LAW ENFORCEMENT VEHICLE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The 1976 Code is amended by adding:

    "Section 23-1-230.    The driver of a law enforcement vehicle may not exceed the speed limit to entice the driver of a private motor vehicle to follow him at a speed that exceeds the speed limit in an effort to have the driver of the private motor vehicle charged with speeding by a law enforcement officer traveling in another law enforcement vehicle."

SECTION    2.    This act takes effect upon approval by the Governor.
