TO AMEND CHAPTER 1, TITLE 10, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PUBLIC BUILDINGS AND PROPERTY, BY ADDING SECTION 10-1-210 SO AS TO PROVIDE THAT ALL STATE AGENCIES AND AGENCIES OF THE POLITICAL SUBDIVISIONS OF THE STATE THAT PURCHASE OR USE FERTILIZERS ON GROUNDS LEASED, OWNED, OR MAINTAINED BY THE AGENCY MUST USE AN ORGANIC COMPOST OR FERTILIZERS MADE AND SOLD IN THIS STATE FROM ANIMAL WASTE OTHER THAN HUMAN WASTE THAT IS GENERATED, PREPARED, PACKAGED, AND SOLD IN THIS STATE.
Whereas, the poultry, livestock, and other farm animals in South Carolina generate organic waste products used in compost and fertilizers that are prepared, packaged, and sold in this State; and
Whereas, state agencies, the agencies of all political subdivisions of the State, and private industry that use compost and fertilizers should use as a first alternative organic products, such as compost made and sold in South Carolina; and
Whereas, the use of organic products of this nature on properties such as golf courses, grounds of industrial plants, colleges, universities, public schools, parks, playgrounds, and the grounds of public buildings would help prevent contamination of rivers, ponds, and streams in South Carolina, and would also alleviate the problems of disposing of animal waste in South Carolina. Now, therefore,
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 1, Title 10 of the 1976 Code, is amended by adding:
"Section 10-1-210. All state agencies and agencies of the political subdivisions of this State, however denominated, that purchase or use fertilizers on grounds that are leased, owned, or maintained by the agency must use an organic compost or fertilizers made and sold in this State from animal waste other than human waste that is generated, prepared, packaged, and sold in this State."
SECTION 2. This act takes effect upon approval by the Governor.
