A JOINT RESOLUTION

TO APPROVE REGULATIONS OF THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, RELATING TO STANDARDS FOR LICENSING COMMUNITY RESIDENTIAL CARE FACILITIES, DESIGNATED AS REGULATION DOCUMENT NUMBER 2541, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The regulations of the Department of Health and Environmental Control, relating to standards for licensing community residential care facilities, designated as Regulation Document Number 2541, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.

SECTION    2.    This joint resolution takes effect upon approval by the Governor.

SUMMARY AS SUBMITTED

BY PROMULGATING AGENCY.

This amendment will extricate applicability to facilities that treat those with chemical dependency and addiction from R.61-84. Concurrently, the department has proposed to consolidate the standards for all of the alcohol and drug abuse treatment facilities which DHEC now licenses into one regulation(R.61-93); alcohol and drug abuse treatment programs within existing hospitals will continue to be licensed under the hospital regulation (R.61-16). The department proposes to amend R.61-84 to update and enhance the regulations. In addition, this amendment will: update and expand definitions/interpretations; clarify licensing change requirements; update licensing fee amounts; describe inspection reporting requirements; add reference to department consultations; update and clarify and update classification of standards and enforcement action procedures; update staffing standards; update physical plant/structural requirements; add quality improvement standards; reword sections related to care and services; reword sections regarding resident record content and maintenance; update infection control and tuberculosis screening requirements; update medication management requirements; update meal service requirements; add reporting requirements; enhance resident rights/assurances requirements; reword sections regarding resident record content and maintenance; expand/update emergency preparedness requirements; enhance fire prevention requirements, and add a severability clause. The proposed amendment will rewrite the regulation in its entirety.
