A BILL

TO AMEND SECTION 44-93-100, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS FROM REGULATION FOR GENERATORS OF LESS THAN FIFTY POUNDS OF INFECTIOUS WASTE, SO AS TO REQUIRE SHARPS TO BE MANAGED PURSUANT TO THE REQUIREMENTS OF CHAPTER 93 AND REGULATIONS PROMULGATED UNDER THAT CHAPTER.

    Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 44-93-100(2)(a) of the 1976 Code is amended to read:

    "(a)    sharps must be contained in rigid puncture-resistant containers and may be disposed of as other solid waste managed pursuant to this chapter and any regulations promulgated under this chapter;"

SECTION    2.    Section 44-66-20(6) of the 1976 Code is amended by adding at the end:

    "If a patient unable to consent is being admitted to hospice care pursuant to a physician certification of a terminal illness required by Medicare, that certification meets the certification requirements of this item."

SECTION    3.    This act takes effect upon approval by the Governor.
