A BILL

TO AMEND ACT 939 OF 1954, AS AMENDED, RELATING TO THE CREATION OF THE INMAN-CAMPOBELLO WATER DISTRICT IN SPARTANBURG COUNTY, SO AS TO REQUIRE THAT ALL COMMISSIONERS OF THE DISTRICT MUST RESIDE IN THE DISTRICT OR IN ITS SERVICE AREA.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 2 of Act 939 of 1954, as last amended by Act 156 of 2001, is further amended to read:

    "Section    2.    The district must be operated and managed by a commission to be known as 'Inman-Campobello Water District Commission'. The commission shall consist of five resident electors of the district, who must be appointed by the Governor, upon the recommendation of a majority of the Legislative Delegation of Spartanburg County. All commissioners must reside in the district or in its service area. The appointments are for a term of six years, and in all cases those persons holding office shall continue to hold office until their successors have been appointed and have qualified. The initial terms of office begin as of the effective date of this act, notwithstanding that this may effect a lessening of the duration of the terms of office of the initial members of the commission. Upon the termination of office of any commissioner, a successor must be appointed by the Governor, upon the recommendation of a majority of the Legislative Delegation of Spartanburg County for a term of six years. Any vacancy occurring in the office of commissioner by reason of death, resignation, or otherwise must be filled for the remainder of the unexpired term by appointment of the Governor, upon the recommendation of a majority of the Legislative Delegation of Spartanburg County."

SECTION    2.    This act takes effect upon approval by the Governor.
