A BILL

TO AMEND ACT 769 OF 1973, RELATING TO THE CREATION OF THE REIDVILLE AREA FIRE DISTRICT IN SPARTANBURG COUNTY, SO AS TO ADD TWO ADDITIONAL MEMBERS TO THE BOARD OF FIRE CONTROL AND STAGGER THEIR TERMS .

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 4 of Act 769 of 1973 is further amended to read:

    "Section 4.    After the creation of the Reidville Area Fire District, there is established a board of fire control for the district, to be composed of three five members who shall must be appointed by the Governor upon the recommendation of a majority of the Spartanburg County Legislative Delegation. Provided, that of those first appointed, one member shall serve for a term of two years, one member shall serve for a term of four years, and one member shall serve for a term of six years, or until their successors are appointed and qualify. The members of the board shall serve without pay and shall file annually a report with the Spartanburg County Board of Control, not later than the first of November of each year, showing all activities and disbursements made by the board during the year.

    If at least twenty percent of the qualified electors residing in the district petition the commissioners of election by the first of September of any general election year, the commissioners shall must call an election to be held at the following general election for the purpose of electing a member to the board to succeed the member whose term will expire during such that year, for a six-year term. Thereafter, members shall must be elected in each succeeding general election for terms of six years."

SECTION    2.    The terms of the two additional members added to the board of fire control pursuant to Section 1 of this act expire on the thirty-first of May of the applicable year. One member must be appointed for a term of four years and the other member must be appointed for a term of six years in order to stagger their terms.

SECTION    3.    This act takes effect upon approval by the Governor.
