A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 27-1-60 SO AS TO PROVIDE THAT NO CONTRACTUAL AGREEMENT FOR THE LEASING OF RESIDENTIAL OR COMMERCIAL PROPERTY AND NO HOMEOWNER'S ASSOCIATION BY-LAWS MAY RESTRICT THE LAWFUL FLYING OF THE AMERICAN FLAG ON THE PREMISES.

    Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The 1976 Code is amended by adding:

    "Section 27-1-60.    Notwithstanding any other provision of law, no contractual agreement for leasing residential or commercial property and no homeowner's association by-laws may restrict the lawful flying of the American flag on the premises. However, such agreements and by-laws may restrict the size of the flag to no larger than three feet by five feet."

SECTION    2.    This act takes effect upon approval by the Governor.
