INVITATIONS AND MEMORIAL RESOLUTIONS

    To whom was referred a Concurrent Resolution (S. 652) memorializing the Congress of the United States to waive the matching funds requirement for federal highway funds available to South Carolina pursuant to the Revenue Aligned Budget Authority Act, etc., respectfully

REPORT:

    That they have duly and carefully considered the same and recommend that the same do pass:

A CONCURRENT RESOLUTION

MEMORIALIZING THE CONGRESS OF THE UNITED STATES TO WAIVE THE MATCHING FUNDS REQUIREMENT FOR FEDERAL HIGHWAY FUNDS AVAILABLE TO SOUTH CAROLINA PURSUANT TO THE REVENUE ALIGNED BUDGET AUTHORITY ACT (RABA).

Whereas, after years of being a donor state to the Federal Highway Trust Fund, a situation in which only seventy-three cents of each dollar of federal gasoline taxes collected in this State was returned to South Carolina for highway programs, Congress in the TEA-21 and Revenue Aligned Budget Authority (RABA) Acts has taken significant steps to eliminate the funding inequity for donor states; and

Whereas, this improvement has lead to an eighty-four cents for each dollar return in fiscal year 2000 and an anticipated ninety-five cents for each dollar return in fiscal year 2001, a welcome and long overdue recognition of the past inequitable distribution; and

Whereas, to be able to benefit from this additional federal funding, state funds must be used to match the federal funds, which at current Department of Transportation funding levels requires diversion into the match requirement funds desperately needed for highway maintenance; and

Whereas, since the thrust of the RABA legislation was to alleviate the inequity in the distribution formula for federal highway funds, it is appropriate to waive the matching funds requirements that essentially require donor states to "buy" federal highway funds previously lost to them under the inequitable formula. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That by this resolution, the General Assembly of South Carolina memorializes the Congress of the United States to waive the matching funds requirement for federal highway funds available to South Carolina pursuant to the Revenue Aligned Budget Authority Act (RABA).

Be it further resolved that a copy of this resolution be forwarded to the President of the United States Senate, the Speaker of the United States House of Representatives, the Federal Highway Administrator, and each member of this state's congressional delegation.
