A BILL

TO CONFIRM AND RATIFY ALL PROCEEDINGS OF THE TRUSTEES AND OFFICIALS OF THE JASPER COUNTY SCHOOL DISTRICT IN CALLING AND HOLDING A SPECIAL ELECTION ON SEPTEMBER 29, 2001, PURSUANT TO THE JASPER COUNTY SCHOOL DISTRICT SCHOOL BOND-PROPERTY TAX RELIEF ACT, ON THE QUESTIONS OF ISSUING GENERAL OBLIGATION BONDS IN AN AMOUNT NOT EXCEEDING FORTY-FIVE MILLION NINE HUNDRED SIXTY-NINE THOUSAND NINE HUNDRED SIXTY-FIVE DOLLARS AND IMPOSING A ONE PERCENT SPECIAL SALES AND USE TAX FOR NOT MORE THAN TWENTY-FIVE YEARS, AND AUTHORIZING THE ISSUANCE OF THE BONDS AND THE IMPOSITION OF THE SALES TAX IN FURTHERANCE OF THE VOTE AT THE ELECTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    All acts and proceedings taken by the trustees and officials of the Jasper County School District, in calling and holding a special election on September 29, 2001, on the questions of issuing general obligation bonds in an amount not exceeding forty-five million nine hundred sixty-nine thousand nine hundred sixty-five dollars for the construction and renovation of schools and facilities, and imposing a one percent special sales and use tax for not more than twenty-five years to raise revenues to pay directly the cost of, or debt service on, the bonds are hereby ratified, confirmed, and declared legally effective, as if all such acts and proceedings had been duly authorized by law. This validation and ratification shall include all acts and proceedings performed or taken by the Board of Education of the Jasper County School District, and any individual trustee, school official, or other person pursuant to the Jasper County School District School Bond-Property Tax Relief Act or under the authority or color of any other law, and shall validate the September 29, 2001, special election, notwithstanding any irregularity or omission which may have occurred in the conduct and management of the election, including, but not limited to, the calling of the election, the publication of notice of the election, and the ballots used in the election.

SECTION    2.    The provisions of this act are limited to the correction of defects, irregularities, omissions, and ministerial errors in carrying out statutory provisions which the General Assembly originally could have omitted from the law under which the acts or proceedings were taken, provided that the provisions of this act shall also operate to supply such legislative authorization as may be necessary to validate the proceedings heretofore taken which the General Assembly could have supplied or provided for in the law under which the acts or proceedings were taken.

SECTION    3.    This act takes effect upon approval by the Governor.
