A JOINT RESOLUTION

TO PROPOSE AN AMENDMENT TO ARTICLE XI OF THE CONSTITUTION OF SOUTH CAROLINA, 1895, SO AS TO ADD A NEW SECTION PROHIBITING THE STATE FROM MANDATING, ASSIGNING NEW, EXPANDING OR MODIFYING PROGRAMS OR RESPONSIBILITIES OF SCHOOL DISTRICTS UNLESS FULLY FUNDED BY THE STATE AND TO SPECIFY THAT LOCAL EXPENDITURES BY SCHOOL DISTRICTS OR POLITICAL SUBDIVISION ARE NOT TO BE INCURRED BECAUSE OF SUCH PROGRAMS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    It is proposed that Article XI of the Constitution of this State be amended by adding Section 5 to read:

"Section 5.    The State shall not mandate or assign any new, expanded or modified programs or responsibilities to any school district or other political subdivision unless such programs or responsibilities are fully funded by the State. No such program or responsibility shall in any way necessitate additional local expenditures by a school district or other political subdivision."

SECTION    2.    The proposed amendment must be submitted to the qualified electors at the next general election. Ballots must be provided at the various voting precincts with the following works printed or written on the ballot:

"Must Section 5 be added to Article XI of the Constitution of this State so as to require that the State shall not mandate or assign any new, expanded or modified programs or responsibilities to any school district or other political subdivision unless such programs or responsibilities are fully funded by the State and that no such program or responsibility shall in any way necessitate additional local expenditures by a school district or other political subdivision?

Those voting in favor of the question shall deposit a ballot with ca check or cross mark in the square after the word 'Yes', and those voting against the question shall deposit a ballot with a check or cross mark in the square after the work 'No'.
