A BILL

TO AMEND SECTION 1-31-10, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE COMPOSITION OF THE COMMISSION OF MINORITY AFFAIRS, SO AS TO REQUIRE THE APPOINTMENT OF AT LEAST ONE NATIVE AMERICAN AS A COMMISSION MEMBER.

Whereas, Native Americans were the indigenous inhabitants of this State and the Native American population consists of 27,000 citizens of this State. Thus, Native Americans should have at least one member representing their interests on the Commission for Minority Affairs.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 1-31-10 of the 1976 Code, as last amended by Act 85 of 2003, is further amended to read:

"Section 1-31-10.    There is created a State Commission for Minority Affairs consisting of nine members and the Governor ex officio. The Governor must appoint one person from each of the six congressional districts of the State and three persons from the State at large upon the advice and consent of the Senate. The Governor shall designate the chairman. The members serve for a term of four years and until their successors are appointed and qualify. A vacancy must be filled in the same manner as original appointment for the remainder of the unexpired term. A majority of the members of the commission must be African American. At least one member must be an individual who is affiliated with a state or federally-recognized Native American Tribe."

SECTION    2.    This act takes effect upon approval by the Governor.
