A BILL

TO AMEND CHAPTER 1, TITLE 1, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 23 SO AS TO PROVIDE THAT NO PROVISION OF LAW OR REGULATION, NO POLICY, PROCEDURE, OR GOVERNMENTAL ACTION OF A STATE ENTITY OR POLITICAL SUBDIVISION OF THE STATE, AND NO FUNDS APPROPRIATED PURSUANT TO STATE LAW MAY GRANT PREFERENTIAL TREATMENT TO AN INDIVIDUAL OR GROUP BASED ON THE CRITERION OF RACE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 1 of the 1976 Code is amended by adding:

"Article 23

Preferential Treatment

Section 1-1-1710.     No provision of law or regulation, no policy, procedure, or governmental action of a state entity or political subdivision of the State, and no funds appropriated pursuant to state law may grant preferential treatment to an individual or group based on the criterion of race."

SECTION    2.    This act takes effect upon approval by the Governor.
