VERSIONS OF THIS BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-63-245 SO AS TO ENACT THE "SCHOOL TEACHER AUTHORITY ACT OF 2003" TO PROVIDE THAT A SCHOOL TEACHER MAY SUSPEND A STUDENT FROM ONE TO FIVE DAYS FOR VIOLATIONS OF SCHOOL DISCIPLINARY CODES FOR OFFENSES THAT WARRANT SUSPENSION AND TO PROVIDE THAT A STUDENT SO SUSPENDED MAY NOT RECEIVE CREDIT FOR OR MAKE UP WORK MISSED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. This act may be cited as the "School Teacher Authority Act of 2003".
SECTION 2. Article 3, Chapter 63, Title 59 of the 1976 Code is amended by adding:
"Section 59-63-245. (A) In addition to other school suspension provisions provided by law, a public school teacher may suspend a student from the teacher's school for a suspension period of one to five school days for a violation of the school's or school district's disciplinary code for offenses warranting suspension that occur on school property or at events sponsored by the school or school district.
(B) A teacher suspending a student shall give written notice and a reason on forms provided by the school district and signed by the teacher. The suspension is effective after the notice is filed with the school district's administrative office and routed through the principal's office, and is not subject to appeal.
(C) A student so suspended may not receive credit for or make up work missed."
SECTION 3. This act takes effect upon approval by the Governor.
