A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 6-1-135 SO AS TO REQUIRE ALL POLITICAL SUBDIVISIONS OF THE STATE RECEIVING ANY STATE FUNDS TO OBSERVE STATE LEGAL HOLIDAYS, TO PROVIDE THAT PAYMENT OF STATE FUNDS OTHERWISE DUE A POLITICAL SUBDIVISION MUST BE SUSPENDED IF A POLITICAL SUBDIVISION FAILS TO OBSERVE ALL STATE LEGAL HOLIDAYS, AND TO DEFINE "POLITICAL SUBDIVISION".

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 1, Title 6 of the 1976 Code is amended by adding:

"Section 6-1-135.    Effective January 1, 2004, a political subdivision of this State receiving any state funds by ordinance must provide for the observance of the state legal holidays provided pursuant to Section 53-5-10. Payment of state funds otherwise due a political subdivision must be suspended if such an ordinance is not in effect on January 1, 2004. The State Treasurer, before making disbursements of state funds to a political subdivision after December 31, 2003, shall verify that the required ordinance is in effect. For purposes of this section a political subdivision of this State is a county or municipality.

Nothing in this section may be construed to limit the authority of a political subdivision (1) to provide for the observance of holidays other than state legal holidays; or (2) manage the schedule of personnel on holidays for purposes of maintaining vital services."

SECTION    2.    This act takes effect upon approval by the Governor.
