A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-40-55 SO AS TO ESTABLISH A CHARTER SCHOOL APPROVAL COMMITTEE WHICH IS ALSO AUTHORIZED TO APPROVE CHARTER SCHOOL APPLICATIONS, AND TO PROVIDE THAT AN APPLICANT DESIRING TO FORM A CHARTER SCHOOL MAY EITHER FILE THE APPLICATION WITH THE LOCAL SCHOOL BOARD OF TRUSTEES IN THE MANNER PROVIDED BY LAW OR IN THE ALTERNATIVE MAY FILE THE APPLICATION DIRECTLY WITH THE CHARTER SCHOOL APPROVAL COMMITTEE WHICH SHALL ACT AS THE SPONSOR OF THE CHARTER SCHOOL AND AS THE APPROVING ENTITY FOR THAT CHARTER SCHOOL.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 40, Title 59 of the 1976 Code is amended by adding:

"Section 59-40-55.    (A)    A Charter School Approval Committee is hereby established and is also authorized to approve charter school applications in the manner provided in this section. The committee shall consist of seven members, two of whom shall be appointed by the Speaker of the House of Representatives, two of whom shall be appointed by the President Pro Tempore of the Senate, and three of whom shall be appointed by the Governor, one of whom shall be designated by the Governor as chairman. Members shall serve for terms of four years and until their successors are appointed and qualify, except that of those members first appointed, one appointed by the Speaker of the House of Representatives, one appointed by the President Pro Tempore of the Senate, and one appointed by the Governor shall serve for initial terms of two years each, in order to stagger the terms of committee members, with the initial terms of all members to be designated by their appointing authority when making the appointments. Members shall receive the usual mileage, subsistence, and per diem paid to members of state boards, commissions, and committees to be paid from the accounts of the State Department of Education. Four members shall constitute a quorum at all meetings of the committee.

(B)    An applicant desiring to form a charter school may either file the application with the local school board of trustees in the manner provided by this chapter or in the alternative may file the application directly with the Charter School Approval Committee which shall act as the sponsor of the charter school and as the approving entity for that charter school. In the event the applicant chooses to file the application with the Charter School Approval Committee, all references in this chapter to the local school board of trustees as the approving entity for the charter school application and related matters shall be construed to mean the Charter School Approval Committee and the appeal provisions in Section 59-40-90 to the state board in the event of a denial of an application by a local school board of trustees also applies to decisions made by the approval committee.

(C)(1)    If an applicant pursuant to subsection (B) applies to the Charter School Approval Committee to form a charter school, it shall also provide a copy of the application to the local school board of the school district in which the proposed charter school shall be located either before or at the same time it files its application with the Charter School Approval Committee.

(2)    The local board shall review the application and may offer suggestions or recommendations to the applicant or the Charter School Approval Committee prior to its acting on the application.

(3)    The Charter School Approval Committee shall give due consideration to suggestions or recommendations made by the local school board under item (2).

(D)    The Charter School Advisory Committee established under Section 59-40-70 shall not be involved in applications submitted to the Charter School Approval Committee and shall only perform functions relating to applications filed with local school boards.

(E)    The Charter School Approval Committee shall review and, by majority vote, either approve or deny the application within ninety days after the application is received by the committee."

SECTION    2.    This act takes effect upon approval by the Governor.
