A BILL

TO AMEND SECTION 42-15-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE NOTICE REQUIRED TO BE GIVEN TO AN EMPLOYER BY AN EMPLOYEE AFTER AN ACCIDENT, SO AS TO CHANGE FROM NINETY TO FOURTEEN DAYS THAT THE NOTICE MUST BE GIVEN.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 42-15-20 of the 1976 Code is amended to read:

"Section 42-15-20.    Every Each injured employee or his representative, shall immediately on the occurrence of an accident, or as soon thereafter after that as practicable, shall give or cause to be given to the employer a notice of the accident and the employee shall is not be entitled to physician's fees nor to any compensation which may have accrued under the terms of this title prior to before the giving of such this notice, unless it can be is shown that the employer, his agent or representative, had knowledge of the accident or that the party required to give such this notice had been prevented from doing so by reason of physical or mental incapacity or the fraud or deceit of some third person. No Compensation shall be is not payable unless such the notice is given within ninety fourteen days after the occurrence of the accident or death, unless reasonable substantial excuse is made to the satisfaction of the commission for not giving such the notice and the commission is satisfied that the employer has not been prejudiced thereby by it."

SECTION    2.    This act takes effect upon approval by the Governor.
