A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 29-5-24 SO AS TO PROVIDE THAT A PERSON WHO PROVIDES PLANNING AND ZONING SERVICES IN CONNECTION WITH A TRACT OF REAL ESTATE IS CONSIDERED TO HAVE PROVIDED MATERIALS TO IMPROVE THE REAL ESTATE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 5, Title 29 of the 1976 Code is amended by adding:

"Section 29-5-24.    A person who provides professional services necessary to the zoning or rezoning of a tract of real estate, specifically planning and establishment of entitlements for the subject property, is considered to have furnished material for improvement of real estate within the meaning of Section 29-5-20 and Section 29-5-40."

SECTION    2.    This act takes effect upon approval by the Governor.
