TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 9-11-42 SO AS TO ALLOW EMPLOYERS OF CERTIFIED EMERGENCY MEDICAL PERSONNEL FOR PURPOSES OF THE SOUTH CAROLINA RETIREMENT SYSTEM TO BECOME AN EMPLOYER WITH RESPECT TO SUCH PERSONNEL IN THE SOUTH CAROLINA POLICE OFFICERS RETIREMENT SYSTEM, TO DEFINE EMERGENCY MEDICAL PERSONNEL, AND TO PROVIDE THAT THE REQUIREMENTS FOR SUCH MEMBERSHIP AND REQUIREMENTS APPLICABLE FOR EMERGENCY MEDICAL TECHNICIANS TO BECOME MEMBERS OF THE SOUTH CAROLINA POLICE OFFICERS RETIREMENT SYSTEM ARE IDENTICAL TO THE REQUIREMENTS APPLICABLE TO EMPLOYERS OF FIREFIGHTERS AND REQUIREMENTS APPLICABLE FOR FIREFIGHTERS TO BECOME MEMBERS, WITH THE APPROPRIATE CHANGES MADE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 11, Title 9 of the 1976 Code is amended by adding:
"Section 9-11-42(A) Notwithstanding any other provisions of law, a county, municipality, or other political subdivision of the State, and any agency or department thereof which is participating in the South Carolina Retirement System with respect to emergency medical personnel in its employ, may become an employer under the South Carolina Police Officers Retirement System with respect to such personnel by applying to the board for admission to the system and complying with the rules and regulations of the board. The application must set forth the requested date of admission, which is July 1, 2004, or any subsequent July first next following the receipt by the board of the application.
(B) As used in this section, emergency medical personnel include an attendant, attendant-driver, and driver as are defined in Section 44-61-20, incorporating all other definitions provided in that section necessary to define such personnel.
(C) All requirements applicable to firefighters with respect to this chapter apply with respect to emergency medical personnel except as these requirements may be modified in subsection (A) or (B), mutatis mutandis."
SECTION 2. This act takes effect upon approval by the Governor.
