A BILL

TO AMEND SECTION 44-53-445, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE SEPARATE OFFENSE OF DISTRIBUTING A CONTROLLED SUBSTANCE WHILE IN, ON, OR WITHIN ONE-HALF MILE OF A SCHOOL, PARK, VOCATIONAL OR TECHNICAL SCHOOL, OR COLLEGE OR UNIVERSITY, SO AS TO EXTEND THE OFFENSE TO INCLUDE A PUBLIC OR PRIVATE DAYCARE FACILITY, PUBLIC OR PRIVATE KINDERGARTEN, AND A PRIVATE VOCATIONAL OR TECHNICAL SCHOOL.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 44-53-445(A) of the 1976 Code is amended to read:

"(A)    It is a separate criminal offense for a person to distribute, sell, purchase, manufacture, or to unlawfully possess with intent to distribute, a controlled substance while in, on, or within a one-half mile radius of the grounds of a public or private daycare facility, kindergarten, elementary, middle, or secondary school; a public playground or park; a public or private vocational or trade school or technical educational center; or a public or private college or university."

SECTION    2.    This act takes effect upon approval by the Governor.
