A BILL

TO PROVIDE THAT UNTIL THE GRAY DRIVE RAILROAD BRIDGE LOCATED IN THE WILLIAMSTON COMMUNITY OF ANDERSON COUNTY IS REPAIRED AND THE SAFETY OF THE BRIDGE CERTIFIED BY THE DEPARTMENT OF TRANSPORTATION, THE RIGHTS-OF-WAY GRANTED TO A RAILROAD COMPANY BY ANDERSON COUNTY TO USE THE LAND OVER WHICH THE BRIDGE IS LOCATED ARE SUSPENDED DUE TO A BREACH OF THE DUTY TO EXERCISE REASONABLE CARE IN USING THESE RIGHTS-OF-WAY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Notwithstanding any other provision of law, until the Gray Drive railroad bridge located in the Williamston community of Anderson County is repaired and the safety of the bridge certified by the Department of Transportation, the rights-of-way, if any, granted to a railroad company by Anderson County to use the land over which the bridge is located are suspended due to a breach of the duty to exercise reasonable care in using these rights-of-way.

SECTION    2.    This act takes effect upon approval by the Governor.
