A JOINT RESOLUTION

TO PROVIDE THAT IF A DESIGNEE OF A PUBLIC OFFICIAL TO SERVE ON THE EDUCATION OVERSIGHT COMMITTEE IS A MEMBER OF THE NATIONAL GUARD OR RESERVES AND HAS BEEN CALLED TO ACTIVE DUTY IN CONNECTION WITH THE CONFLICT WITH IRAQ OR THE WAR ON TERRORISM FOR A PERIOD OF NOT MORE THAN ONE YEAR, THE PUBLIC OFFICIAL MAY DESIGNATE ANOTHER PERSON TO SERVE IN HIS STEAD IN AN INTERIM CAPACITY UNTIL THE ORIGINAL DESIGNEE RETURNS FROM ACTIVE DUTY, AND TO PROVIDE THAT ABSENCES OF THE ORIGINAL DESIGNEE ON THE COMMITTEE BECAUSE OF MILITARY ACTIVATION ARE CONSIDERED EXCUSED ABSENCES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    If a designee of a public official to serve on the Education Oversight Committee established by Section 59-6-10 of the 1976 Code is a member of the National Guard or reserves and has been called to active duty in connection with the conflict with Iraq or the war on terrorism for a period of not more than one year based on his military orders, the public official may designate another person to serve in his stead on the Education Oversight Committee in an interim capacity until the original designee returns from active duty. The interim designation may not exceed a period of one year but is renewable.

(B)    Absences of the original designee on the committee because of military activation are considered excused absences.

SECTION    2.    This joint resolution takes effect upon approval by the Governor.
