A BILL

TO AMEND SECTION 23-1-225 OF THE 1976 CODE, RELATING TO ALLOWING RETIRED LAW ENFORCEMENT OFFICERS TO RETAIN STATUS AND WEAPONS, TO PROVIDE THAT UPON RETIREMENT, MUNICIPAL AND COUNTY LAW ENFORCEMENT OFFICERS ALSO MAY RETAIN THEIR STATUS AND WEAPONS, WITH THE EXCEPTION OF POWERS OF ARREST.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 23-1-225 of the 1976 Code is amended to read:

"Section 23-1-225.    (A)    Upon retirement, state law enforcement officers may retain their commissions in retired status with all rights and privileges, including the right to retain their service weapons issued while serving in active duty status.

(B)    Upon retirement, municipal and county certified Class 1 law enforcement officers may retain their commissions, with the exception of powers of arrest, in retired status with all other rights and privileges, including the right to retain their service weapons issued while serving in active duty status. Each retired certified Class 1 law enforcement officer's commission shall be renewed annually by the jurisdictional officer in command to preserve the commission."

SECTION    2.    This act takes effect upon approval by the Governor.
