A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 39-5-31 SO AS TO MAKE IT AN UNLAWFUL TRADE PRACTICE TO INCLUDE A NEGOTIABLE INSTRUMENT IN A SOLICITATION IF THE NEGOTIATION OF THE INSTRUMENT BY THE ADDRESSEE CREATES A CONTRACT FOR THE SOLICITED PURCHASE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 5, Title 39 of the 1976 Code is amended by adding:

"Section 39-5-31.    It is an unlawful trade practice pursuant to Section 39-5-20 for a person to include in a solicitation for the sale of a product or service an enclosure that is, or purports to be, a check or other negotiable instrument made payable to the order of the addressee, the endorsement, and negotiation of which by the addressee creates a contract for the purchase of the solicited product or service."

SECTION    2.    This act takes effect upon approval by the Governor.
