A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-17-515 SO AS TO PROVIDE THAT IT IS UNLAWFUL FOR A PERSON TO INTERFERE WITH THE TRANSPORTATION OF STUDENTS BY SCHOOL BUS WITH THE INTENT TO DELIBERATELY DELAY OR IMPEDE THE PROCESS OF TRANSPORTING STUDENTS, TO PROVIDE FOR THE SUSPENSION OF THE DRIVER'S LICENSE OF A PERSON WHO VIOLATES THE PROVISIONS OF THIS SECTION, TO PROVIDE THAT THIS SECTION DOES NOT APPLY TO AN ACCIDENT BETWEEN A SCHOOL BUS AND ANOTHER VEHICLE, AND TO PROVIDE A PENALTY.

SECTION    1.    Article 7, Chapter 17, Title 16 of the 1976 Code is amended by adding:

"Section 16-17-515.    (A)    It is unlawful for a person to interfere with the transportation or passage of students to or from school by school bus with the intent to deliberately delay or impede the process of transporting students to a public or private school or other school program.

(B)    A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one thousand dollars or imprisoned not more than two years, or both.

(C)    In addition to the penalties provided in subsection (B), a person convicted of a violation of this section shall have his driver's license suspended for not less than six months.

(D)    The provisions of this section do not apply to an accident involving a school bus and another vehicle when there is no intent by the driver to deliberately delay or impede the process of transporting students."

SECTION    2.    This act takes effect upon approval by the Governor.
