A BILL

TO AMEND SECTION 44-55-1330, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE INSTALLATION REQUIREMENTS OF THE PASSIVE SOIL-BASED ON-SITE DISPOSAL SYSTEM, SO AS TO PROVIDE FOR ALL SYSTEMS INSTALLED AFTER JUNE 2, 2004, THE STORAGE CAPACITY OF THE SYSTEM BELOW THE INVERT MUST BE AT LEAST THAT AVAILABLE IN A CONVENTIONAL GRAVEL SYSTEM BELOW THE INVERT AND TO PROVIDE THAT THE STORAGE CAPACITY IS DETERMINED BY ACTUAL MEASUREMENTS OF THE FIELD INSTALLED PRODUCT IN A REPORT TO THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL FROM A PUBLIC OR INDEPENDENT FOUR-YEAR INSTITUTION ACCREDITED BY THE SOUTHERN ASSOCIATION OF COLLEGES AND SECONDARY SCHOOLS OR FROM NSF INTERNATIONAL.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 44-55-1330(3)(a) of the 1976 Code, as added by Act 49 of 2003, is amended to read:

"(a)    For all systems installed after June 2, 2004, The the storage capacity of the system below the invert must be at least that available in a conventional gravel system below the invert. Each manufacturer shall provide its product's storage capacity as determined by a recognized third party testing company actual measurements of the field installed product in a report to the department from a public or independent four-year institution of higher learning which is accredited by the Southern Association of Colleges and Secondary Schools or NSF International."

SECTION    2.    This act takes effect upon approval by the Governor.
