A BILL

TO AMEND SECTION 59-150-360, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EDUCATION LOTTERY ACT TUITION ASSISTANCE, SO AS TO PROHIBIT A STUDENT WHO HAS BEEN ADJUDICATED DELINQUENT OR CONVICTED OR PLED GUILTY OR NOLO CONTENDERE TO A FELONY OR AN ALCOHOL OR DRUG RELATED OFFENSE FROM BEING ELIGIBLE FOR LOTTERY TUITION ASSISTANCE, AND TO PROVIDE AN EXCEPTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 59-150-360(A) of the 1976 Code, as last amended by Act 356 of 2002, is further amended by adding item (6) at the end to read:

"(6)    not have been adjudicated delinquent or been convicted or pled guilty or nolo contendere to a felony or an alcohol or drug related offense under the laws of this or another state or under the laws of the United States, except that a high school or college student otherwise qualified who has been adjudicated delinquent or has been convicted or pled guilty or nolo contendere to an alcohol or drug related misdemeanor offense is eligible or continues to be eligible for a grant after the expiration of one academic year from the date of the adjudication, conviction, or plea."

SECTION    2.    This act takes effect upon approval by the Governor.
