A BILL

TO PROVIDE THAT THE POWER TO LEVY THE ANNUAL MILLAGE NECESSARY TO FUND THE OPERATING AND CAPITAL EXPENSES OF WILLIAMSBURG COUNTY TECHNICAL EDUCATION COLLEGE IS TRANSFERRED FROM THE WILLIAMSBURG COUNTY SCHOOL BOARD OF TRUSTEES TO THE WILLIAMSBURG COUNTY COUNCIL AND TO REPEAL SECTION 7 OF ACT 632 OF 1980.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    Notwithstanding any other provision of law, the authority to provide for the annual millage to be levied for the benefit of Williamsburg County Technical Education College is transferred from the Williamsburg County School Board of Trustees to the Williamsburg County Council. The council, when preparing the annual budget for the county, shall determine an appropriate millage to be levied to provide for the necessary operating and capital expenditures of the college. The county auditor shall then levy and the county treasurer shall then collect such millage in the same manner as other taxes levied against property. The provisions of this section shall be effective for the property tax levy for year 2004 and thereafter.

(B)    The council may issue bonds within the bonded debt limit of the county to fund necessary capital expenditures of the college.

SECTION    2.    Section 7 of Act 632 of 1980 is repealed.

SECTION     3.    This provision takes effect upon approval of the Governor.
