A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-117-110 SO AS TO PROVIDE THAT THE REMAINS OF ANY PERSON WHO DONATED HIS OR HER BODY TO THE UNIVERSITY OF SOUTH CAROLINA MEDICAL SCHOOL FOR SCIENTIFIC RESEARCH PURPOSES MUST BE INTERRED BY THE MEDICAL SCHOOL AT ITS EXPENSE IN A MARKED CEMETERY GRAVESITE IF THE REMAINS WERE BURIED OR IF THE REMAINS WERE CREMATED IN A MEMORIAL GARDEN CRYPT WHICH IDENTIFIES THE DECEDENT'S ASHES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 117, Title 59 of the 1976 Code is amended by adding:

"Section 59-117-110.    The remains of any person who donated his or her body to the University of South Carolina Medical School for scientific research purposes must be interred by the medical school at its expense in a marked cemetery gravesite if the remains were buried or if the remains were cremated in a memorial garden crypt which identifies the decedent's ashes. The provisions of this section apply prospectively and also shall apply retroactively at the option of the surviving family."

SECTION    2.    This act takes effect upon approval by the Governor.
