THE COMMITTEE ON EDUCATION

To whom was referred a Bill (S. 857) to amend the Code of Laws of South Carolina, 1976, by adding Section 59-117-110 so as to provide that the remains of any person who donated, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking Section 59-117-110 of the 1976 Code, as contained in SECTION 1, and inserting:

/    Section 59-117-110.    The University of South Carolina School of Medicine may remove and relocate, at its expense, the cremains of a person, whose body was donated to and the cremains interred by the school of medicine from a grave or cemetery in the State to a memorial garden maintained at the school of medicine. Before the removal and relocation, the school of medicine shall notify the Department of Health and Environmental Control but is not required to obtain a permit as may otherwise be required by law or regulation. /

Renumber sections to conform.

Amend title to conform.

EXPLANATION OF IMPACT:

The University of South Carolina estimates the maximum non-recurring cost of this bill to be $200,000. Attempts would be made to locate all family members of past donors. If all the ashes of donors buried in the previous 20 years must be moved to a memorial garden at the School of Medicine, the school would have to build an addition to the existing memorial garden. Removal and replacement of remains in the memorial garden will also be an expense. Recurring costs once the memorial garden is expanded (if necessary) would be minimal. The impact on the General Fund of the State is at the discretion of the General Assembly. This initiative could be funded with general funds and/or University other funds revenue.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-117-110 SO AS TO PROVIDE THAT THE REMAINS OF ANY PERSON WHO DONATED HIS OR HER BODY TO THE UNIVERSITY OF SOUTH CAROLINA MEDICAL SCHOOL FOR SCIENTIFIC RESEARCH PURPOSES MUST BE INTERRED BY THE MEDICAL SCHOOL AT ITS EXPENSE IN A MARKED CEMETERY GRAVESITE IF THE REMAINS WERE BURIED OR IF THE REMAINS WERE CREMATED IN A MEMORIAL GARDEN CRYPT WHICH IDENTIFIES THE DECEDENT'S ASHES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 117, Title 59 of the 1976 Code is amended by adding:

"Section 59-117-110.    The remains of any person who donated his or her body to the University of South Carolina Medical School for scientific research purposes must be interred by the medical school at its expense in a marked cemetery gravesite if the remains were buried or if the remains were cremated in a memorial garden crypt which identifies the decedent's ashes. The provisions of this section apply prospectively and also shall apply retroactively at the option of the surviving family."

SECTION    2.    This act takes effect upon approval by the Governor.
