A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-23-75 SO AS TO PROVIDE THAT A VALID MARINE DEALER'S PERMIT ENTITLES THE MARINE DEALER TO ALLOW A PROSPECTIVE PURCHASER OF A USED WATERCRAFT OR OUTBOARD MOTOR OWNED BY A PERSON OTHER THAN A DEALER TO USE THE WATERCRAFT OR MOTOR ON A TRIAL OR DEMONSTRATION BASIS FOR UP TO FORTY-EIGHT HOURS WITHOUT THE REQUIREMENT OF NEW REGISTRATION, NUMBERING, OR TITLING.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 23, Title 50 of the 1976 Code is amended by adding:

"Section 50-23-75.    (A)    A valid marine dealer's permit held by a marine dealer entitles the marine dealer to allow a prospective purchaser of a used watercraft or outboard motor owned by a person other than a dealer but in the dealer's possession for the purpose of resale or trade-in to use the watercraft or motor on a trial or demonstration basis for up to forty-eight hours without the requirement of new registration, numbering, or titling whether or not the registration, numbering, or titling has expired. Upon the sale of that used watercraft or motor, new registration, numbering, and titling is required as provided in Section 50-23-60. The department by regulation shall specify what written evidence is required to be carried by the prospective purchaser when operating the used watercraft or motor on a trial or demonstration basis.

(B)    The use of new watercraft or motors by prospective purchasers is governed by the provisions of Section 50-21-35."

SECTION    2.    This act takes effect upon approval by the Governor.
