To whom was referred a Bill (S. 98) to amend Section 23-6-300, Code of Laws of South Carolina, 1976, relating to the creation of functions, duties, and responsibilities of the Department of Public Safety's Motor Vehicle Division, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, page 1, line 35, in Section 23-6-300(B), as contained in SECTION 1, by striking line 35 in its entirety and inserting therein the following:

EXPLANATION OF IMPACT:

Note: To date, no response to the potential fiscal impact of this Bill has been received from the Department of Public Safety's Division of Motor Vehicle Division. The explanation below was used as it was submitted in response to the potential fiscal impact of House Bill 4620 of the last legislative session since they are identical in nature. Should different information be received from the agency, it will be forwarded in a revised fiscal impact statement.

The Department of Public Safety (DPS) states there would be no impact on the General Fund of the State as the bill merely authorizes the Division of Motor Vehicles (DMV) to enter into contracts with the specified entities. Assuming that DMV undertook to contract out certain services, the division would have to conduct contract negotiations to determine whether there would be added costs or savings associated with contracting with and the supervision of the parties who would provide the services.

A BILL

TO AMEND SECTION 23-6-300, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CREATION OF FUNCTIONS, DUTIES, AND RESPONSIBILITIES OF THE DEPARTMENT OF PUBLIC SAFETY'S MOTOR VEHICLE DIVISION, SO AS TO PROVIDE THAT THE MOTOR VEHICLE DIVISION MAY ENTER INTO CONTRACTS WITH PERSONS, CORPORATIONS, OR GOVERNMENTAL SUBDIVISIONS TO PROVIDE SERVICES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 23-6-300 of the 1976 Code is amended to read:

"Section 23-6-300.    (A)    There is created a The Motor Vehicle Division is created within the department. The division shall be is responsible for all of those functions, duties, and responsibilities previously exercised by and/or or operating under the Division of Motor Vehicles of the South Carolina Department of Highways and Public Transportation, or both.

(B)    The Motor Vehicle Division may enter into contracts with persons, corporations, or governmental subdivisions in localities throughout the State to issue motor vehicle license plates, registration cards, renewal stickers, and certificates of title. The division shall supervise the provision of services contained in this subsection, and a person or an entity that the division contracts with pursuant to this subsection may charge fees in excess of the fees established under Title 56."

SECTION    2.    This act takes effect upon approval by the Governor.
