A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-29-225 SO AS TO PROVIDE THAT THE SUPERINTENDENT OF EDUCATION SHALL APPOINT CURRICULUM ADVISORY COMMITTEES IN CERTAIN SUBJECT AREAS TO DEVELOP AND RECOMMEND STATEWIDE CURRICULUM TO THE STATE BOARD OF EDUCATION, AND TO PROVIDE THAT THE DEPARTMENT OF EDUCATION SHALL ENSURE THAT ALL TEXTBOOKS BEING USED OR ON THE APPROVED INSTRUCTIONAL MATERIAL MASTER LIST ARE ALIGNED WITH ADOPTED STATE ACADEMIC AND PERFORMANCE STANDARDS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1.    Article 1, Chapter 29, Title 59 of the 1976 Code is amended by adding:

"Section 59-29-225.    (A)(1)    By August 1, 2006, the Superintendent of Education shall prepare an outline for development and implementation utilizing appropriate groups and appoint curriculum advisory committees in each of the following subject areas: mathematics, science, social studies, and English/language arts. Each curriculum advisory committee must be compromised of nine members to include at least four teachers, one from a rural school, one from an urban school, and one from a failing school; one member of a school improvement council; one administrator; one curriculum director; and other experts designated by the superintendent. Each curriculum advisory committee shall develop and recommend curriculum to the State Board of Education. Curriculum advisory committees also may address other issues as determined by the Department of Education.

(2)    The Department of Education shall provide the curriculum advisory committees with adequate staff, existing curricula, and other pertinent information to help the committee in its curriculum development.

(B)(1)    By August 1, 2007, the State Board of Education shall adopt not more than three curricula aligned to adopted state academic and performance standards in mathematics, science, social studies, and English/language arts to be used in kindergarten through twelfth grade in the public schools of this State. These curricula must be selected or developed by the State Board of Education in accordance with subsection (A). By the 2007-08 school year, all public schools shall implement the curriculum adopted by the State Board of Education that best suits their needs.

(2)    The curricula adopted by the State Board of Education must:

(a)    be aligned with state standards and assessments utilized by the State Department of Education; and

(b)    contain sufficient detail to guide teachers in planning lessons aligned with state standards and assessments.

(C)    By the 2007-08 school year, the Department of Education shall ensure that all textbooks being used or on the approved instructional material master list are aligned with adopted state academic and performance standards. These textbooks and instructional materials also must provide appropriate and direct support to the curricula adopted pursuant to this subsection."

SECTION 2.    This act takes effect upon approval by the Governor.
