A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 40-43-190 SO AS TO REQUIRE A PHARMACIST TO ONLY CHARGE MEDICAID PRESCRIPTION RATES, PLUS A DISPENSING FEE, WHEN FILLING PRESCRIPTIONS FOR PERSONS RECEIVING MEDICARE BENEFITS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    This act may be cited as the "Medicare Pharmacy Discount Program Act".

SECTION    2.    Chapter 43, Title 40 of the 1976 Code is amended by adding:

"Section 40-43-190.    Notwithstanding any other provision of law, when filling prescriptions, a pharmacist may only charge a person receiving Medicare benefits the amount allowed by Medicaid for the same prescription, plus a dispensing fee."

SECTION    3.    This act takes effect upon approval by the Governor.
