A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-5-135 SO AS TO PROVIDE THAT IT IS UNLAWFUL TO EXPORT FOR COMMERCIAL PURPOSES LIVE SEA OR FRESHWATER TURTLES WHICH ARE CAUGHT OR CAPTURED IN THE WILD IN THIS STATE AND TO PROVIDE PENALTIES FOR VIOLATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 5, of Title 50 of the 1976 Code is amended by adding:

"Section 50-5-135.    It is unlawful to export for commercial purposes live sea or freshwater turtles which are caught or captured in the wild in this State. Any person violating the provisions of this section is guilty of a misdemeanor, and upon conviction, must be punished by a fine not exceeding one thousand dollars or by a term or imprisonment not exceeding ninety days. Each violation is a separate offense."

SECTION    2.    This act takes effect upon approval by the Governor.
