A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 58-3-15 SO AS TO PROVIDE THAT EFFECTIVE JULY 1, 2005, THE RATES, SERVICE AREAS, FACILITIES, FRANCHISES, TRANSACTIONS, POWERS, DUTIES, AND PROPERTY OF TELEPHONE AND TELEGRAPH UTILITIES SHALL NO LONGER BE REGULATED BY THE PUBLIC SERVICE COMMISSION; AND TO REPEAL CHAPTER 9 OF TITLE 58 RELATING TO TELEPHONE AND TELEGRAPH UTILITIES ON JULY 1, 2005.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 3, Title 58 of the 1976 Code is amended by adding:

"Section 58-3-15.    Effective July 1, 2005, the rates, service areas, facilities, franchises, transactions, powers, duties, and property of telephone and telegraph utilities shall no longer be regulated by the Public Service Commission."

SECTION    2.    On July 1, 2005, Chapter 9 of Title 58 of the 1976 Code is repealed.

SECTION    3.    This act takes effect July 1, 2005.
