A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 46-3-250 SO AS TO ESTABLISH WITHIN THE DEPARTMENT OF AGRICULTURE THE STATE NUTRITION ASSISTANCE PROGRAM (SNAP) FOR THE PURPOSE OF PROVIDING FUNDS TO SOUTH CAROLINA FOOD BANKS IN ORDER TO SUPPLEMENT BY PURCHASE THE DONATED FOOD DISTRIBUTED BY THESE FOOD BANKS AND PROVIDE FOR THE DISTRIBUTION AND USES OF FUNDS APPROPRIATED FOR THE SNAP PROGRAM.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 3, Title 46 of the 1976 Code, is amended by adding:

"Section 46-3-250.    (A)    There is created within the Department of Agriculture the State Nutrition Assistance Program (SNAP) as a nutrition program that provides annual funding to nonprofit food banks in this State to allow these food banks to supplement by means of purchases the food currently donated to them.

(B)    Funds appropriated annually for SNAP must be distributed by the department to a combination of food banks that serve all counties of this State. Each individual food bank must share in the distribution in the proportion that the population in its service area that is below the federal poverty index is of the total of the state's population under that income threshold. This distribution formula may be adjusted by the department to take into account other sources of funding available to these respective food banks. Of the funds distributed, an amount not to exceed ten percent may be expended by the recipient banks for transportation and distribution expenses. An additional amount not to exceed five percent may be expended by the recipient food banks to provide nutritional education and the balance must be expended directly on food purchases. To the extent practicable, food purchases using these funds must primarily be made with South Carolina-based producers, wholesalers, and retailers.

(C)    The General Assembly, by appropriations in the annual general appropriations act, and acts and joint regulations supplemental thereto, shall appropriate from the general fund of the State those funds it determines sufficient for annual SNAP funding."

SECTION    2.    This act takes effect July 1, 2005.
