A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-1-175 SO AS TO PROVIDE THAT ANY PERSON WHO MAKES A COMPLAINT TO THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL CONCERNING AN ALLEGED HEALTH CODE VIOLATION BY A RESTAURANT MUST PROVIDE HIS NAME AND CONTACT INFORMATION TO THE DEPARTMENT, AND IF A SUBSEQUENT INSPECTION IS CONDUCTED AND THE HEALTH CODE VIOLATION IS NOT FOUND, THE DEPARTMENT SHALL PROVIDE THE RESTAURANT, UPON REQUEST, WITH THE COMPLAINANT'S NAME AND CONTACT INFORMATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 44 of the 1976 Code is amended by adding:

"Section 44-1-175.    A person who makes a complaint to the Department of Health and Environmental Control shall provide the department with his or her name and contact information. If the department conducts an inspection of the restaurant in response to this complaint and finds no violations contained in or related to the complaint, the department shall provide the restaurant, upon request, with the name and contact information of the complainant."

SECTION    2.    This act takes effect upon approval by the Governor.
