A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-17-160 SO AS TO PROVIDE THE MINIMUM NUMBER OF STUDENTS THAT EACH SCHOOL DISTRICT MAY HAVE IN THE DISTRICT'S AVERAGE DAILY ATTENDANCE AND PROVIDE AN EXCEPTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 17, Title 59 of the 1976 Code is amended by adding:

"Section 59-17-160.    (A)    Beginning with school year 2007-08, each school district may not have fewer than eight thousand students in the district's one hundred thirty-five-day average daily attendance. A school district with fewer than eight thousand students shall consolidate with another district.

(B)    Notwithstanding the provisions of subsection (A), a school district may have fewer than eight thousand students in the district's one hundred thirty-five-day average daily attendance if it is the only school district in the county.

(C)    The provisions of this section do not apply to a statewide school district."

SECTION    2.    This act takes effect upon approval by the Governor.
