THE COMMITTEE ON AGRICULTURE, NATURAL

RESOURCES AND ENVIRONMENTAL AFFAIRS

To whom was referred a Bill (H. 4660) to amend Section 48-39-10, as amended, Code of Laws of South Carolina, 1976, relating to definitions in regard to coastal tidelands and wetlands, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/SECTION    1.    Section 48-39-290(A)(7) of the 1976 Code, as last amended by Act 198 of 2002, is further amended to read:

"(7) above-ground pools constructed of a synthetic material such as, but not limited to, plastic or fiberglass may be placed above grade, and traditional in-ground pools may be reconstructed if they are landward of an existing, functional erosion control structure or device;"

SECTION    2.    This act takes effect upon approval by the Governor.    /

Renumber sections to conform.

Amend title to conform.

A BILL

TO AMEND SECTION 48-39-10, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS IN REGARD TO COASTAL TIDELANDS AND WETLANDS, SO AS TO DEFINE THE TERM "POOL".

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 48-39-10 of the 1976 Code, as last amended by Act 181 of 1993, is further amended by adding a new item to read:

"(X)    'Pool' means an in-ground structure designed and used for swimming and wading."

SECTION    2.    This act takes effect upon approval by the Governor.
