A BILL

TO AMEND CHAPTER 5, TITLE 56, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REGULATION OF TRAFFIC ALONG THE STATES' HIGHWAYS BY ADDING ARTICLE 8, SO AS TO PROVIDE THAT A LAW ENFORCEMENT AGENCY MAY ESTABLISH AUTOMATIC TRAFFIC CONTROL SYSTEMS IN HIGHWAY WORK ZONES AND SCHOOL ZONES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 5, Title 56 of the 1976 Code is amended by adding:

"Article 8

Automatic Traffic Control Systems

Section 56-5-1100.    A law enforcement agency may establish automated traffic control systems in highway work zones and school zones. An automated traffic control system may operate only during periods when workers are present in a highway work zone or during school hours in a school zone.

Section 56-5-1105.    As used in this article:

(A)    'automated traffic control system' means a photographic device, radar device, laser device, or another electrical or mechanical device or devices designed to record the speed of a vehicle and obtain a clear photograph or other recorded image of the vehicle, the vehicle operator, and the vehicle's registration plate while the driver is committing a traffic violation. The photograph or other recorded image also must display the time, date, and location of the violation. A law enforcement officer is not required to be present or to witness the violation.

(B)    'Owner' means the person or entity to whom the vehicle is registered.

Section 56-5-1110.    (A)    A law enforcement agency must conduct a public information campaign to inform drivers about the use of automated traffic control systems in highway work zones and school zones before establishing these systems. A law enforcement agency shall adopt rules and regulations for implementing this article.

(B)    Signs indicating that speeds are enforced by automated traffic control systems must be clearly posted in the areas where the systems are in use.

(C)    Operation of automated traffic control systems are limited to highway work zones and school zones.

(D)    Photographs obtained in this manner may be used only as evidence in relation to traffic violations. The photographs are available only to the owner of the vehicle, the offender, and the offender's attorney, the court, the local solicitor, and law enforcement officials.

(E)    If the driver of the vehicle cannot be identified through the photograph, the vehicle's owner may not be charged with the violation. If the driver can be identified, the driver must be charged with the violation.

Section 56-5-1115.    (A)    The vehicle, vehicle operator, vehicle license plate, speed, date, time, and location must be clearly visible on the photograph or other recorded image of the alleged violation.

(B)    A Uniform Traffic Ticket must be mailed or delivered to the registered owner of the vehicle. If mailed, the ticket must be sent by certified mail within six business days of the alleged violation, return receipt requested.

(C)    The Uniform Traffic Ticket must include:

(1)    the name and address of the vehicle owner;

(2)    the registration number and license plate number of the vehicle;

(3)    the offense charged;

(4)    the time, date, and location of the violation;

(5)    notice that the basis of the ticket is the photograph or recorded image from the automated traffic control system.

(D)    The Uniform Traffic Ticket issued to the violator must be accompanied by a written document that lists the violator's rights and obligations and explains how the violator can elect to proceed by either paying the fine or challenging the issuance of the Uniform Traffic Ticket.

Section 56-5-1120.    A person issued a ticket under this article may respond to the ticket in person or by any method allowed by law.

Section 56-5-1125.    A photograph or other recorded image evidencing a traffic violation is admissible in any proceeding resulting from the issuance of a Uniform Traffic Ticket. Photographs or recorded images made by an automatic traffic control system are confidential and must be made available only to the defendant and to governmental or law enforcement agencies for the purpose of adjudicating a driving violation.

Section 56-5-1130.    (A)    A Uniform Traffic Ticket issued under this article to a motor vehicle rental or leasing company must be dismissed with respect to the rental or leasing company if:

(1)    the company responds to the Uniform Traffic Ticket by submitting, within thirty days of the mailing of the ticket, an affidavit of nonliability stating that, at the time of the alleged traffic violation, the vehicle was in the custody and control of a renter or lessee under the terms of a rental agreement or lease; and

(2)    the company provides the drivers license number, name, and address of the renter or lessee.

(B)    A Uniform Traffic Ticket dismissed with respect to a motor vehicle rental or leasing company in accordance with subsection (A) then may be issued and delivered by mail or other means to the renter or lessee identified in the affidavit of nonliability."

SECTION    2.    This act takes effect upon approval by the Governor.
