A BILL

TO AMEND SECTION 12-21-6050, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DISTRIBUTION OF FUNDS RECEIVED FROM STAMP TAXES REQUIRED TO BE PAID BY A DEALER POSSESSING MARIJUANA OR OTHER CONTROLLED SUBSTANCES UNDER THE SOUTH CAROLINA MARIJUANA AND CONTROLLED SUBSTANCE TAX ACT, SO AS TO PROVIDE THAT INSTEAD OF ALL PROCEEDS OF THE TAX GOING TO THE STATE GENERAL FUND, FIFTY PERCENT OF THE PROCEEDS MUST BE DISTRIBUTED TO THE LAW ENFORCEMENT AGENCY INVESTIGATING THE CASE AND RESPONSIBLE FOR THE ARREST.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 12-21-6050 of the 1976 Code is amended to read:

"Section 12-21-6050.    The department shall credit fifty percent of the proceeds of the tax levied by this article to the general fund of the State, and shall transmit the remaining fifty percent to the law enforcement agency investigating the case and responsible for the arrest if an arrest is made."

SECTION    2.    This act takes effect upon approval by the Governor.
