EXPLANATION OF IMPACT:

The Workers' Compensation Commission reports this bill will have no impact on the General Fund of the State or on federal and/or other funds. The bill changes the statute to conform to the agency's current structure and practice.

A BILL

TO AMEND SECTION 42-3-25, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE RELATIONSHIP BETWEEN THE CHAIRMAN, EXECUTIVE ASSISTANT, AND ADMINISTRATIVE DIRECTOR OF THE SOUTH CAROLINA WORKERS' COMPENSATION COMMISSION, SO AS TO ELIMINATE THE POSITION OF EXECUTIVE ASSISTANT FOR THE JUDICIAL DEPARTMENT; TO AMEND SECTION 42-3-80, AS AMENDED, RELATING TO THE ADMINISTRATIVE DIRECTOR OF THE ADMINISTRATIVE DEPARTMENT OF THE WORKERS' COMPENSATION COMMISSION, SO AS TO CHANGE THE NAME OF THE ADMINISTRATIVE DIRECTOR TO THE EXECUTIVE DIRECTOR; AND TO REPEAL SECTION 42-3-50, RELATING TO THE EXECUTIVE ASSISTANT FOR THE JUDICIAL DEPARTMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 42-3-25 of the 1976 Code is amended to read:

"Section 42-3-25.    The chairman shall be is the chief executive officer of the Commission commission and shall execute the policies established by the Commission commission in its capacity as the governing body of the judicial and administrative departments.

The executive assistant for the judicial department and the administrative director of the administrative department commission shall report to the chairman and be responsible to the chairman commission."

SECTION    2.    The first paragraph of Section 42-3-80 of the 1976 Code, as last amended by Act 85 of 2005, is further amended to read:

"Section 42-3-80.    The administrative department of the commission shall be under the direction of the administrative executive director. The director must be appointed by the commission, shall serve at its pleasure, and shall receive an annual salary not to exceed eighty-five percent of the salary paid to the commissioners."

SECTION    3.    Section 42-3-50 of the 1976 Code is repealed.

SECTION    4.    This act takes effect upon approval by the Governor.
